Abstract: There are still many problems in the protection of personal information rights of online consumers in China. For example, the definition of personal information is not clear, the legal attributes and contents of the right to personal information are lacking, the standards for the determination of infringement are not uniform, the legislation is scattered, and so on. The relevant legal provisions are also more general, and the maneuverability is not strong, which resulted in consumers safeguard rights and interests with difficulty. The author believes that in order to effectively protect the personal information of Internet consumers, we can start with the concept of personal information, precisely locate the concept of personal information, the legal attributes and contents of the right to personal information. Then it constructs the identification standard of infringing network consumers personal information right, and consummates the responsibility system of infringing network consumers personal information, that is, putting the burden of proof upside down and formulating a unified personal information protection law. And also need to establish a special personal information protection agency. It is hoped that this paper can provide useful reference for the personal information protection of internet consumers in our country.
